► My father passed away last july. We are two children, eldest me the daughter and younger brother. Mother is alive.He had told us that he has written a will. But my brother has hidden the will and telling others that father hadn't written any. When we tried to negotiate with him, he attacked us. He has a temporary job. Dear Client,

I am very sorry for your loss. According to Indian law, being a daughter, you can have the same rights in the property of your father even when you are divorced. In case your father has failed to leave a valid will, the property will be equally shared among your mother, yourself and your brother- one third each. Your brother has no legal right to refuse to give you what you are supposed to get. In case a will was written by your father, the will should be presented and proved before court. Your brother cannot just keep it a secret and declare that there is no will. In case he is concealing the will, his behavior can be inquired in court.

In case he has assaulted you then this is a criminal case and you can complain to the police about assault. In the case of the property, you can give a legal notice and file a partition suit in the civil court to get your share as well as request the court to prevent him to sell the property. Be sure to keep in mind, the law affords you equal protection and rights, he can not take everything or give everything away on the basis that he is the son.
