Regarding execution case and a title suit of same property

► I am a jdr in an execution case and D.P is going to be issue very soon but now suddenly a third party appears with proper documents and file a title suit on same property and he made me a respondent on that case he submitted all his court fees and formality but noticed not served to me . Please help me how could I take a stay order on my execution case

The mere pendency of a title suit initiated by any third party does not necessarily lead to a stay or a halt to the execution proceedings. Where the third party is claiming to have a right over the property and has filed a title suit in support, the proper thing for you to do is to report the matter to the executing court. Based on your specific situation, an application can be filed before the executing court seeking that there should be a stay of execution proceedings until the title issue is decided, since proceeding with execution at this stage will amount to irreparable injury to your cause resulting into contradictory decisions. It is pertinent to mention here that notice in the title suit seems to have not been received by you. You can obtain a copy of the plaint and other documents and consult an advocate at once.
