Dear Sir,
As a general principle, an employer's exit and F&F policy must comply with applicable labour laws, employment contracts, standing orders (if any), and principles of natural justice. An internal policy cannot override statutory rights of employees. Any clause that is contrary to law may be held unenforceable even if it has been included in the policy.
Dear Client,
We would be pleased to review your Employee Exit and F&F policies of your organisation, all you need to do is forward a copy of the same to us and we will assess whether any provisions are inconsistent with applicable Indian labour and employment law. We will get back to you at the earliest ones you have handed over the copies of the policies.
I hope this helps and if you have any further issues do not hesitate to contact us.
