WhatsApp termination, LinkedIn warning sent in distress, and employer contacting family
1 Answer
Dear Client,
Whether or not your LinkedIn message will create any liability will depend on what exactly the content of the message was. If the message had any kind of false statements which can damage the reputation of the CA firm, then there can be claims for defamation; however, the point that you have withdrawn the post or warning in writing and have not persisted in its publication may be relevant while evaluating the claim. The mere act of voicing your concerns on employment dispute or warning people based on your belief is not likely to amount to liability. In regard to the behavior of the CA, who is trying to avoid you, contacting your family members, sending forward your personal communications and threatening to sue you just to force you to withdraw your labor complaint, you need to keep all the messages, emails, call records and screenshots. You may direct an advocate to send a legal notice to the effect that all communication relating to the dispute should be done with you or through your advocate and contacting your family members should not take place, among other retaliatory acts, in respect of the pending labor dispute.
I hope this helps and if you have any further issues do not hesitate to contact us.
