► My partner and I are both over 18, and we are living together by our own choice. However, my partner's parents are threatening to murder me and are trying to separate us by force. We are planning to do a live-in agreement and affidavit for our safety. What is the complete legal process and required documents for this in West Bengal? Also, what legal steps should we take to protect ourselves from these life threats and potential false criminal cases from her family?"

Dear Client,

In your case, adult individuals who are more than 18 years are constitutionally permitted to cohabit with consenting people in accordance with Article 21 of the Constitution. Even though a notarised live-in agreement and an affidavit on a non-judicial stamp paper help to establish the consent by both parties and protect them from any future wrongful charges, it does not automatically give them legal immunity for criminal acts committed. To seek assistance against the dangers to life, it is advisable to lodge a complaint with the local police station and with the Superintendent of Police as per the provisions of Section 351 of the Bharatiya Nyaya Sanhita (BNS) Act 2023. Moreover, if the threat is immediate, an application can be filed with the Calcutta High Court under Article 226 for police protection. I hope this answer helps.
