► I am a resident of Varanasi Uttar pradesh. My house was built in 2008 in Varanasi city the structure of the house are inside the limits of the land purchased but the boundary of the house is outside the land limits. Since my house is located in the interior of a colony so it didnt affect much traffic on the road ,but now after 18 year this year 2025 i got a notice from nagar nigam varanasi that i have encroached the road and i should demolish it as they have already done the mapping and measurements. I got to know that a person from my colony who wants to become local politician has made this unnecessary complain to harrass me and my family to show his strength in the colony, even though i accept that little encroachment has been done by my boundary wall but it doesn't hinders any traffic or caused any inconvenience to my neighbors or any body, now i am trying to find a legal solution , because even though nagar nigam official are ready to solve tha matter by bribe but i know even after the bribe is paid he will complain again to harass me. I need to find a legal solution to this

Thank you for sharing your situation in detail. I completely understand how distressing this must be for you and your family, especially after residing peacefully for over 18 years.

Please note, even a minor encroachment on government land, particularly in Uttar Pradesh, is taken seriously once officially identified, and municipal authorities are empowered to take action. However, you have valid legal options to defend yourself and seek relief:

Legal Remedies You Can Pursue:

1. File a Reply to the Notice:

You must immediately file a written reply to Nagar Nigam Varanasi denying intentional encroachment and explaining the factual circumstances.

Mention the long possession, lack of any prior objections, and the absence of public inconvenience.

2. Apply for Compounding/Regularization:

In certain cases, Uttar Pradesh Urban Local Body Bylaws allow regularization or compounding of minor encroachments on payment of a penalty.

This option depends on the exact extent of encroachment and zoning rules. I can help check if this is possible for your property.

3. File a Writ Petition in High Court (If Needed):

If Nagar Nigam proceeds with demolition without fairly considering your reply or violates due process, a writ petition under Article 226 can be filed in the Allahabad High Court.

Grounds may include harassment, mala fide complaint, or violation of natural justice.

4. Apply for a Stay Order:

A stay order can be requested from the civil court or High Court to stop demolition, if you're able to show you’re ready to cooperate or regularize.

5. File Complaint Against Misuse of Power:

If the complainant is misusing influence to harass you, you can file a written complaint with higher Nagar Nigam officials or Lok Ayukta.

Avoid Paying Bribes:

As you rightly said, bribes will not provide permanent protection, and may lead to future blackmail or repeated complaints. Legal remedies are safer and long-lasting.

Next Steps:

Please contact me directly with your notice copy, property documents, and photos of the boundary. I will prepare a strong legal reply to the Nagar Nigam and guide you further based on exact records.

I will help with:

Drafting reply to notice

Negotiating for compounding/regularization

Filing stay/writ in court

All documentation & representation

Your matter requires timely legal action, and I’m here to support you every step of the way.nineonesix3OsoxfiveOtwotwo

An encrocher cannot validate its encroachment by any means. Get your boundary within your land and vacate the encroached govt. land. Your other pleas are not worthy and same can not justify your illegal encroachment.
