The Guardians and Wards Act, 1890, lays down the key legal provision. The father of the child is entitled to file a petition in the concerned Family Court to seek custody or visitation rights. Even if the courts tend to prefer the mother when it relates to the physical custody of very young children, the main legal consideration is the “welfare of the child.” This includes keeping strong relationships with the father’s family. You can begin this process by sending a formal notice and (if that does not lead to any amicable settlement) please consider filing a petition with the court.
