Dear Client,

To recover possession of your property, send a suitable legal notice to the tenant under Section 106 of the Transfer of Property Act 1882 before the expiration date in October. The notice should also indicate that you do not intend to renew the tenancy agreement and seek recovery of the premises. If the tenant does not cooperate, you can file an application for issuing an eviction order in Court, seeking compensation for “mesne profits.” Evictions of a contested nature generally take anywhere from one to three years, depending on the backlog of the civil courts and the applicability of local Rent Control Acts.

I hope this answer helps. If you have any further query kindly do not hesitate to contact us. Thank you

You sent him a notice first. If he would not vacate the premises you may file a case against him to do so.
