► One of my family member was falsely accused for a case and the police have grabbed him by chasing him on the road and when they did that, his mother was with him and they asked her to take an auto from the middle of the road and took him along with his bike, mobile and him. Now we see that fir was filed against him without prior notice or interrogation of the accused and the police wouldn't say where he is and he was taken by CI of the same branch police station and the mother was sent to the station with another policemen forcefully and she couldn't find her son.

For registration of FIR no advance notice or prior interrogation of accused is not required. Police has every power to arrest the named accused. File bail application under guidance of a competent lawyer and also file WRIT of habeas corpus petition in high court, so as to get information, about the whereabouts of accused and get him produced in court.
