► Dear Sir/Madam, I hereby humbly request your kind guidance/clarifications for the below queries: 1.In Rajasthan State Road Transport Corporation Ltd. & Ors. v. Smt. Mohani Devi & Anr., decided on 15 April 2020, SC held that the expression “Termination of employment” under Section 4(1) Gratuity Act, 1972 is of wide import and includes resignation. As per the Supreme Court case law, it is therefore held that the company’s claim that “Section 4(1)(c) provides gratuity only in cases of termination due to disablement” is untenable and accordingly stands set aside!! 2.Is gratuity claim made under Section 4(1)(C)- death or disablement due to accident or disease applicable for resignation made by the employee or the gratuity claim under this section can be claimed only when the employer terminates the employee from the service?
