Courts Generally Don’t Cancel or Waive EMIs
There is no automatic right to stop paying EMIs through a court order.
But, courts can grant temporary relief in certain exceptional situations, such as:
Genuine financial hardship (job loss, medical emergency, disaster, etc.)
Unfair or illegal actions by the bank/NBFC (e.g., wrong interest rate, premature auction, harassment)
Pending restructuring request ignored by the bank
Natural calamities, pandemic-like events, or government-mandated moratoriums
