Query Regarding Threat of Illegal Access to My Call Records (CDR)

► I need your advice on a privacy concern. My fiancé said that he’ll get the CDR (call detail record) of my mobile number through a friend who works in the cyber branch, to check if I had any past relationships. I just want to understand if that’s legally or illegally possible and what I can do to protect my privacy if he or his friend try to misuse their position

Hi,

 

This is possible. However, it is not legal. 

 

No person in official capacity can use it position and power and abuse the same. To give CDR one requires an order of the Court or else it needs to be through a proper channel of investigation on the basis of a complaint. In your case it is neither of the two. 

 

If something like this happens it is definitely a breach of your privacy and invasion of your right to privacy. 

 

You can send representations to higher police authorities and cyber department heads if in case such mis-deed ever takes place. You can further file a Writ for ‘Police Excess Action’ and pray for removal and suspension of the official including non payment of benefits including retirement benefits. This will hurt his career vastly. 

 

You can also lodge a FIR against your fiancé for bribing a government executive officials and charge your fiancé with criminal conspiracy, Criminal Breach of Trust and various other penal sections.
