In you case there are two ways
Mutual Divorce
You are requested to propose your husband to agree or sit down with terms of settlement with regards to Maintenance, custody of the child, alimony, property rights and other assets and liabilities held jointly. Execute a MOU and file for a mutual divorce. This is only possible when Both spouses consent to divorce. This is a hassle free and speedy remedy to obtain divorce.
Contested Divorce
In the alternative, you will have to file a contested divorce as against your husband stating the reasons for seeking dissolution of the instant marriage. This process is lengthy, time consuming and involves various other litigations and cases which need to be handled simultaneously.
