DV case is not a divorce. For divorce case you can file separate divorce case. Every divorce case is contest case until parties agree for divorce by mutual consent.

Sir, this is a tactful strategy applied by the advocates who litigate from the eifes end. Divorce will be the last case they will file. They will file several other cases for the purpose of creating pressure.
Please make sure you handle the ‘Assets and Liability’ well and engage a good advocate to deal with your mater.
You can file divorce, there is no bar to the same.

If the marriage has broken down and she has filed DV, that itself indicates matrimonial discord.
You may file:
Contested Divorce under Section 13 of the Hindu Marriage Act, 1955 on grounds like cruelty, desertion, etc.
Or, if she agrees later, Mutual Consent Divorce under Section 13-B.
Filing divorce from your side will not affect her DV case directly, but the cases may run parallel.
Later, both can be settled together in mediation.
