► I have a property related query between two brothers, elder one being my dad and younger one includes my uncle. After my grand father passed away two years ago, they have differences in dividing the house area in village. While elder brother built the house and then relocated due to work, you get brother settled in the same house and later modified the house without consulting elder brother. While elder brother got to know about house modification after several months, he didn't say a word as my grandfather was staying in vilkage. Now after he's passed away, there is a dispute going on between two brothers on rightful allocation of the house. How do we proceed in this scenario.

Dear Sir,

               So both your father and your uncle have equal ownership share, regardless of:

Who paid for constructing the house

Who lived in the house

Who renovated it

These actions do not give exclusive ownership unless there is written agreement or proof of exclusive title.

If grandmother is alive, she also has an equal share.

Father should file suit for partition to get all properties divided equally by meats and bounds.

There are various ways to do this 

Presuming your grand father expired without a Will. 

 

The House can be divided by doing the following 

 

Both the people can mutually accept certain terms and conditions and and get a partition deed / family settlement deed registered. 

 

Either one of them can sell his 50% share to the other and take valuable consideration amount. 

 

You can file a Partition suit against your uncle and get the property partitioned by metes and bounds by a courts order.
