Dear client,

If you have been married for 21 years and are facing mental torture, you can file for divorce on the ground of mental cruelty under section 13(1)(ia) of the Hindu Marriage Act 1955. Mental torture includes constant insults, humiliation, emotional abuse, or behaviour that affects your peace of mind. You do not need to prove physical violence. If the cruelty has continued for a long time and has made it impossible for you to live with him, the court can grant you divorce. You can file the petition in the family court where you are living now.

if husband is willing for mutual divorce, you can go ahead with mutual divorce otherwise you have to file contested divorce case. before filing divorce case, you may issue a legal notice, to understand the stand of the Husband.

Aap 20 saal se shaadi mein hain aur aap financially independent bhi hain. Agar aap sirf mental torture ke basis par apne pati se divorce chahte hain, to yeh legally possible hai. India ke Divorce laws mein, mental cruelty (maansik atyachaar) ko ek valid ground maana gaya hai, chahe Hindu Marriage Act ho ya kisi aur personal law ke tahat shaadi hui ho.

Aapke liye kya options hain:

1. Contested Divorce (Agar husband tayyar nahi hai divorce dene ko):

  • Aap Family Court mein ek contested divorce petition file kar sakti hain under Section 13(1)(ia) of Hindu Marriage Act, 1955 (mental cruelty ke ground par).
  • Isme aapko court ko batana hoga (aur agar ho sake to dikhana bhi hoga) ki kaise aur kis tareeke se aapko maansik roop se atyachaar diya gaya.
  • Mental torture ke examples ho sakte hain:
    • Bar-bar beizzati karna
    • Emotional blackmail
    • Doubt aur ilzaam lagana
    • Communication tod lena, neglect karna
    • Atyadhik control ya possessiveness
    • Public shaming, social isolation

2. Mutual Consent Divorce (Agar husband bhi divorce chahte hain):

  • Dono parties agree karte hain ki ab saath nahi reh sakte, to Section 13B ke tahat aap mutual consent se bhi divorce le sakti hain.
  • Isme 6 mahine ka cooling-off period hota hai (jo kuch cases mein waive ho sakta hai).

Aapko kya karna chahiye:

  • Apne mental torture ke saboot (agar possible ho) ikattha karein — jaise WhatsApp chats, call recordings, witnesses, diary notes, etc.
  • Ek experienced family lawyer se mil kar legal notice bhej sakti hain ya directly divorce petition file kar sakti hain.
  • Aapko maintenance ya alimony claim karne ki zarurat nahi hai agar aap financially stable hain — but yeh aapka legal right hai, agar kabhi chahiye ho to.

For divorce, you are required to consult a competent lawyer and to file divorce petition in court. You are also entitled to maintenance, expenses of litigation, share in husband's properties acquired or purchased after marriage etc.
