Dear Client, If there are tender documents, ITRs, profit-sharing records, or other documents showing your father and his friend as 50-50 partners, those documents can be important evidence that a partnership existed. The fact that the friend later started showing your father as an employee does not automatically mean that no partnership existed. Partnership can be proved through documents, profit-sharing arrangements, tax records, bank records, and the conduct of the parties. However, since the matter appears to involve events spanning many years, the availability of any legal remedy will depend on the specific facts, supporting documents, and limitation issues. Partnership matters are generally governed by the Indian Partnership Act, 1932, and your father should have all available records reviewed by a lawyer to assess his legal options.
