► Hello, (I am writing on behalf of my aunt.) "I was living in my home (chawl) for almost 39 years in Mumbai, but as of 2023, the chawl is being redeveloped. So, my brother filed a case against me for a share in my house the same year using a voter ID card. I have all the documents (POA, WILL from my mother); every bill that came to the house is in my name; the builders know me, and I have been here for a long time. My parents gave my brother a very big house in Goa, and this small house was given to me. My lawyer did not do much, but when my brother passed away this year in January, he dismissed the case. My brother's wife reopened the case, stating that she is his widow, so she and her two sons should have a share. My sister-in-law travels, and sometimes she and her lawyer never show up to court, and during all these instances, the court case is deferred to another date. I asked my lawyer, and he says he cannot do anything about it; neither does he talk to the judge nor present my documents. What can I do? Please suggest."

A chawal too seem on tenancy. A tenant always remain a tenant. ID card is not a proof of ownership nor the same confer any ownership. Case of brother is not maintainable. Rest can be advised only on examining court case papers and other facts of the case.
