File a suit for:

Declaration that neighbour has no right/title

Permanent injunction against construction

Mandatory injunction for demolition (if construction done)

Dear Sir, as per your query,

 

You need to send a legal notice, demanding they immediately vacate the site. If they do not vacate the site say after 15-20 days, then you need to file an encroachment complaint with Revenue officer. File a written objection stating that BBMP issued khata for land not existing in the layout plan and without title documents. Still if no action is taken, you need to seek a permanent injunction from the Civil Court restraining the neighbour from interfering with the property and for removal of encroachment.
