Dear Client, If a criminal case is pending against you, you should generally disclose it in your passport application. Section 6(2)(f) of the Passports Act, 1967 is relevant where criminal proceedings are pending before a court. Since the Passport Office issued a notice seeking an explanation and you did not respond for about one year, you should immediately check the status of the application and consult a lawyer. In many cases, persons with pending criminal cases can obtain a passport after obtaining appropriate permission or directions from the court concerned and complying with the applicable passport rules. The fact that a case is pending does not automatically mean that a passport can never be issued, but the non-disclosure and the unanswered notice need to be addressed promptly.
