Dear Sir,

Yes — you can legally object to your brother installing a CCTV camera in the common entry/exit passage, even if there is no stay order from the court.

A stay order is not mandatory to object when:

The act affects common property

The act prejudices another co-owner

The act causes privacy invasion

Dear Sir, as per your query,

1. Yes, you can object—during a pending partition suit, a co-owner cannot unilaterally install CCTV in a common passage affecting joint possession and privacy without consent.

2. You may issue a legal notice and move an application before the trial court seeking removal or restriction of the camera despite no stay order.
