► My husband now married for 13 years have multiple sex partners ...sex workers. I stay in USA currently for a work assignment. I have a 11 year old son staying with me. Can I file for full child custody and get it? My child has stayed with me since birth and I have taken care of him financially and emotionally. I earn much more than my husband and have assets on my name. For my own assets or my band account salaries can he claim any of those? All is property I bought on my own. Husband is also earning a handsome salary in India. All my marriage jewellery is with my husband and my mother in law. All bought by my parents and myself. Will I get them back?

Under your given circumstances you need to contest the following matters; 

 

  1. File a divorce proceedings as against your husband with all the proof that you have. 
  2. File an application for alimony in the Matrimonial Proceedings 
  3. File an application for child custody 
  4. Lodge a complaint and file a case for stridhan 

 

The courts take this very seriously and if what you are saying is true and gets proved. You can get child custody
You can seek permanent custody as the child has lived with you since birth, is 11 years old, and your husband’s conduct affects the child’s welfare. 

Your income and assets are protected
Your salary, bank accounts, US earnings, and assets purchased in your own name are your self-acquired property. Your husband has no legal right or claim over them, especially since he is independently earning.

Stridhan is yours so it must be returned
All jewellery given by your parents or purchased by you is your absolute property, even if kept with your husband or mother-in-law. You are legally entitled to its return or monetary value through DV proceedings or criminal/civil action.
