► I have given money to my fried on behalf of giving me a job but he failed to do so and now he is unreachable but I tried contacting their parents and they told me to payback but it's been an year they haven't paid yet and they are also now not recieving calls and texts is their any way we can get the money back and I have proof of upi payments and some whatsapp texts but no such agreement

Dear Client, as per your query, You may recover your money by filing either a summary suit under Order 37 of the Code of Civil Procedure or a regular money claim suit. Indian courts also accept digital evidence such as UPI transaction IDs or WhatsApp conversations as proof of debt, even in the absence of a written agreement. Since it is a job scam and you are unable to reach the other person, you may also file a criminal complaint for cheating and criminal breach of trust under Sections 318 and 316 of the Bharatiya Nyaya Sanhita by filing it on the National Cyber Crime Reporting Portal or by calling 1930. This may also result in freezing their bank account. Since your debt is now one year old, you are well within the three-year deadline to start these proceedings. I hope this answer is helpful.
