► I borrowed Rs. 25000 in 2021 from one 0f my friend and the interest rate was 10 percent per month. I keep on paying the interest till march 2026. From April onwards i won,t pay till march 2026 i have paid Rs. 1,20,000 as interest amount only. Now the person is threatening me to bring police to my office and also called my HR and sent mail also. I there any legal action that i can take against him.

first Give legal notice through Advocate.

after that you have 2 option

  1. File criminal complaint for punishment.
  2. File Civil defamation suit for Compensation.

Dear Client, The lender can take legal steps to recover any money that is genuinely due, but he cannot threaten, harass, or intimidate you. If he is repeatedly threatening you, contacting your HR, or trying to damage your reputation at your workplace, keep copies of all emails, messages, call records, and any communication sent to your employer.

You should also keep proof of the loan and all payments made by you, including bank transfers, receipts, and messages. Based on what you have stated, you borrowed ₹25,000 and claim to have already paid ₹1,20,000 as interest, which is a relevant fact that should be properly documented.

If the threats or harassment continue, you may consider making a police complaint or seeking legal advice regarding the appropriate remedy. From the facts stated, you took a loan of ₹25,000 in 2021 and have already paid approximately ₹1,20,000 towards the interest that seems to be much higher than the principal amount. Even though you will continue to owe whatever is legally payable by you, an interest rate of 10% per month (which amounts to 120% per year) could be questioned on the basis of the applicable laws, and it could also be viewed as excessive depending on the circumstances and the kind of business conducted by the lender. Your friend has no legal authority to harass, threaten, or bully you into repaying the loan, nor is he entitled to contact your HR department and employer in order to collect his money. In case he intimidates or threatens you, you can preserve all your email communications and telephone calls, and lodge a complaint with the police against his harassment and intimidation.
